General conditions for the provision of Aletheia e-commerce services through access to the Creditreform WEB Site and Credit Card Payment

ARTICLE 1 - OBJECT OF THE CONTRACT 
This contract covers the provision, via electronic link to the Creditreform Web Site (www.creditreform.it), of commercial information of the type, in the forms and at the costs described therein. The said information are confidential for the requesting party and further disclosure by any means to third parties is prohibited. The requesting party accepts the risk inherent in the fact that the said information is the result of automatic processing, and therefore assumes all risks connected with the use thereof.
Creditreform may broaden or restrict the range of commercial information obtainable from its own Site by giving 30 days' notice thereof on the same Site. 

ARTICLE 2 - ACCESS HOURS AND E CONDITIONS
Creditreform allows access to the service from 8 am to 8 pm of business days, from Monday to Friday. Any variations of hours will be promptly communicated on the Site, and the same will apply in case of suspensions for non-routine maintenance needs or force majeure events. Creditreform will not be responsible for any access difficulties owing to problems with the external electronic network and/or hardware or software difficulties with the Client's equipment. 

ARTICLE 3 - REGISTRATION AND  CREATION OF ACCOUNT
Upon registration, the client will be requested to enter a user-id and access password. 
The User will be responsible for the full management of the password and therefore for any unauthorised use by third parties arising from theft or loss. In these cases, the User shall immediately change the password but will in any case be responsible for uses made through the access obtained with the previous password. Should the User request Creditreform to unblock his user-id with a new password, he will be charged Euro 10.00 on his account as administration expenses.

ARTICLE 4 - SERVICE COSTS 
The costs that will be charged on the User's account for the single requests of information are listed in detail in the price list available online on the Web Site. The said costs are inclusive of any dues charged by Public Administrations, vis-à-vis which Creditreform agrees to hold harmless the User from any request originating from the aforementioned P.A. Creditreform may change the price list at any time, and in this case, it will be required to give 30 days' notice thereof on the Web Site. 

ARTICLE 5 - AVAILABLE CREDIT AND PAYMENT 
The credit available to the User is set up and renewed on the Creditreform Web Site by credit card payment. 
Services may be requested only if the funds available are at least equal to or exceed the cost of the service requested. The available credit will be automatically used as the cost of the information requested by the User is charged, on the basis of the applicable price list.
Payment is made via secure link directly to the Bank's web site, which is accessed by entering the user-id and password on the specific page of the Creditreform web site. Upon completion of the payment procedure executed on the Bank's web site, the credit available to the User will be automatically updated on the basis of the payment made.

ARTICLE 6 - DURATION OF REGISTRATION AND RENEWAL 
Registration on the web site, through user-id and password, will be valid  for one year (12 months). The time-limit starts to run every time the funds on the account are replenished. Upon the final expiry of the time-limit, the residual credit will be withheld by Creditreform as administration expenses. 

ARTICLE 7 - OBLIGATIONS AND RESPONSIBILITIES 
The User, in acknowledging that the information supplied by Creditreform through the web site is the result of automatic computerised processing of data collected from various sources and archives of third parties, expressly exempts Creditreform from any responsibility relating to the accuracy and reliability of the same information, and from the consequences deriving from any use the User may make thereof. 
The User agrees to quote the source and date of extraction of the information and to prevent any possibility of its activity being confused with that of Creditreform. The information is to be intended as supplied in the utmost confidentiality and further disclosure thereof to third parties is prohibited. 

ARTICLE 8 - PROTECTION OF PERSONAL DATA 
Creditreform processes the personal data collected in compliance with Legislative Decree No. 196 of 30 June 2003 («Personal Data Protection Code»), for protection of personal data of persons and entities. The User agrees to use and cause to use the data received in compliance with the same criteria provided for in the aforementioned decree, therefore holding Creditreform harmless from and against any civil or criminal law claim of third parties that should arise in connection with the non-compliant use of the information collected.
By clicking on "I accept" the User confirms that he has received the Information provided for in legislative decree of 30 June 2003 no.° 196 and displayed also on the Creditreform web site. 

ARTICLE 9 - JURISDICTION AND APPLICABLE LAW 
The Parties expressly agree that the contract will be governed in accordance with the laws of Italy and that, should any dispute arise in connection therewith, including indirectly, the venue for any legal action will be strictly the court of Modena.
Should the User come under the definition of "Consumer", Modena. "a natural person acting for purposes not referable to any business operations he may carry out", reference will be made, where applicable, to the specific legal provisions set forth in consumer protection legislation.
